Welcome. These Terms of Use ("Terms") govern your access to and use of the website, applications, APIs, and services provided by Showcart ("Showcart", "we", "us", or "our") (collectively, the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. Scope; Acceptance
You represent that you are at least legally able to form a binding contract in your jurisdiction. These Terms (together with any supplemental terms we present for specific features) form a binding agreement between you and Showcart.
2. Accounts & Registration
To use some features you must create an account. Provide accurate information and keep it up to date. You are responsible for activity under your account and for keeping your credentials secure. Do not share account access. We may suspend or terminate accounts that violate these Terms.
3. License to Use the Service
Subject to your compliance with these Terms, Showcart grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal or internal business use.
4. User Content; Inputs & Outputs
Your Content. "Your Content" means anything you upload, submit, or create using the Service (including images, prompts, sketches, videos, and other materials).
Ownership. You retain ownership of Your Content and any Outputs you create. Showcart does not claim ownership of Your Content or Outputs.
License to Showcart. By submitting Your Content or using the Service you grant Showcart a worldwide, non-exclusive, royalty-free license to host, use, reproduce, modify, display and distribute such content for the purpose of providing and improving the Service (including for content moderation, analytics, product development and model training), and for marketing and promotional use. Where required by law or third-party model terms we will comply with applicable restrictions.
Model Training & Improvement. You acknowledge that aggregated and/or anonymized Inputs and Outputs may be used to improve models and services. We will not intentionally publish Identifiable Personal Data in training datasets; however, you should not upload data that you do not have rights to or that is confidential.
5. Acceptable Use & Prohibited Conduct
You agree not to:
- Use the Service to create, upload, or distribute illegal, infringing, sexually explicit, violent, hateful, harassing, or otherwise harmful content.
- Upload images or other content of another person without their consent if required by applicable law.
- Use the Service to train competing AI models, or to extract large-scale datasets (scraping, crawling, or automated downloads) without prior written consent.
- Bypass or attempt to bypass our security, rate limits, or any usage protections.
We may remove or refuse to process content that violates these rules.
6. Moderation & Reporting
We may monitor, review, remove, or refuse to process any content or outputs at our discretion. We may suspend or terminate accounts that violate these Terms. If you encounter content you believe violates these Terms, please use the in-product reporting tools.
7. Third-Party Services & Models
The Service integrates third-party AI models, cloud services, and other providers. These providers may have their own terms and policies; your use of features that rely on them may be subject to those terms. We are not responsible for third-party availability, performance, or policies.
The user is solely responsible for ensuring their use of the Output complies with all relevant third-party model terms. You are the conduit, but the user is the final user. Furthermore Showcart makes no representation or warranty regarding the suitability, accuracy, or non-infringement of any Output generated by a third-party model.
8. Purchases, Subscriptions & Credits
Payments & Billing. Payments are processed by our third-party payment provider. By providing payment details you authorize us to charge for subscriptions and purchased credits.
No Refunds. All purchases (including credits and subscription fees) are final and non-refundable except where required by law.
Self-Serve Cancellation. You may cancel subscriptions anytime from your account dashboard; cancellation stops future billing but you retain access through the end of your current paid period.
Credit Rollover & Expiration. Purchased credits automatically roll over and remain valid for 12 months from the date they were issued. After 12 months unused credits expire and are removed from your account. Promotional or bonus credits may have different expiry terms and are non-refundable.
Taxes & Fees. Prices exclude taxes which you are responsible for where applicable.
9. Copyright Infringement (DMCA) & IP Claims
If you believe content on the Service infringes your copyright, follow our takedown process by providing the required information (owner's signature, identification of the material, location, contact details, and a statement under penalty of perjury). We will respond in accordance with applicable law and may terminate repeat infringers.
10. Indemnity
You agree to indemnify and hold Showcart and its affiliates harmless from any claim, loss, liability or expense (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) Your Content or Outputs; (c) your violation of these Terms; or (d) your violation of any rights of a third party.
11. Disclaimers
The Service (including any Outputs) is provided "as is." Showcart disclaims all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. Outputs may contain errors, biases, or third-party content. You are solely responsible for your use of Outputs.
12. Limitation of Liability
To the maximum extent permitted by law, Showcart's total liability to you for any claim arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you paid Showcart in the three months prior to the event giving rise to liability, or (b) US $100. Showcart is not liable for indirect, incidental, consequential or special damages.
13. Termination
We may suspend or terminate your access at any time for violations of these Terms or where required by law. On termination, we may delete Your Content from live systems; some data may be retained in backups for legal and operational reasons.
14. Dispute Resolution; Arbitration; Opt-Out
Arbitration Agreement. Except where prohibited by law, you and Showcart agree to resolve disputes by binding arbitration rather than in court, except that either party may seek injunctive or equitable relief in court for intellectual-property infringement.
Opt-Out. If you do not want to be bound by arbitration, you may opt out by sending written notice to Showcart's legal contact within thirty (30) days of first agreeing to these Terms. Instructions for opting out are published on our website.
15. Notices & Contact

16. Changes to these Terms
We may update these Terms. We'll post a revised "Last updated" date and, for account holders, notify you. Continued use after changes means you accept the updated Terms.
17. Governing Law & Venue
These Terms are governed by the laws of India.
18. Miscellaneous
These Terms, together with any supplemental terms, constitute the entire agreement between you and Showcart regarding the Service. If any provision is found unenforceable, the remainder will remain in full force.
